HC OKs Maharashtra Airport Co rejecting Anik Industries bid to lease plot

NEW DELHI – The Bombay High Court Thursday upheld Maharashtra Airport Development Co. Ltd.'s rejection of Anik Industries Ltd's bid for allotment of plot of land on lease located at the special economic zone in the Multi Modal international Cargo Hub and Airport at Nagpur. The high court said that the contention that the plot must be allotted to Anik Industries on account of its bid being the highest, by ignoring its technical disqualification, deserves rejection.
"Considering the overall conspectus of the case, we are of the view that petitioner (Anik Industries) is unable to demonstrate any element of arbitrariness, irrationality or perversity in the actions of the tendering authority in implementing the impugned tender process," said the high court. The petition is otherwise devoid of merits, the court added.
The case has its genesis from Maharashtra Airport Development Co. initiating the process of leasing the plot for residential and commercial use in September. After the whole process, the bid of Anik Industries was rejected by Maharashtra Airport Development Co. on account of non-fulfillment of qualifications of technical criteria. Challenging this, Anik Industries moved the high court.
On Thursday, shares of Anik Industries ended 0.8% lower at INR 109.07 on the National Stock Exchange. End
