HC notice to RBI, HDFC Bank in unauthorised fraudulent transaction case

NEW DELHI – The Delhi High Court has issued notices to the Reserve Bank of India and HDFC Bank on a petition by Manmohan Kumar, alleging unauthorised fraudulent transactions of INR 7.5 million carried out from his account maintained with HDFC Bank. The high court will hear Kumar's petition next on Jul. 29.

 

The case has its genesis from Kumar visiting HDFC Bank to get his bank statements where he discovered that his registered mobile number and e-mail ID connected to his bank account were changed without his consent or authentication. The bank statements of petitioner's account showed the unauthenticated registered email ID as loveofhdfc@gmail.com and mobile number as 18002600/18001600, which was the alleged customer care number of HDFC Bank. The petitioner also said that a virtual debit card was created in his name without his consent. 

 

Consequently, the petitioner filed a complaint through an e-mail in December addressed to HDFC Bank requesting them to take immediate steps to investigate the matter. Resultantly, HDFC Bank reversed the debit entries worth INR 7.5 million back to the petitioner's account in January. 

 

However, the petitioner said that no actual action was taken by HDFC Bank on his complaint. Rather, HDFC Bank only kept delaying the matter and misguiding the petitioner by claiming that the issue was under investigation, said Kumar. He alleged that HDFC Bank had communicated to the petitioner that the complaint will be resolved by February, however, later, HDFC Bank unilaterally reversed the previously credited amount from the petitioner's account.

 

Despite petitioner raising concern over the action of HDFC Bank, the latter denied there being any deficiency of service on part of the bank and stated that the transactions were duly authenticated through one time passwords and attributed fault to the petitioner. Thereafter, the petitioner filed an official complaint before the RBI banking ombudsman, however, the complaint was also closed in March stating that there was no deficiency in service on the part of HDFC Bank.

 

Kumar's counsel, in court, said the respondents were trying to pass the blame on the petitioner while refusing to offer any explanation for the fraudulent creation of a virtual debit card and the unauthorised alteration of the petitioner's registered contact details with HDFC Bank. The counsel said the same could only be done with the requisite debit card credentials and one time password based validation that could only be available with the petitioner. Kumar argued that the petitioner never shared such credentials with anyone.

 

 

On Tuesday, the shares of HDFC Bank ended 0.6% higher at INR 1,960.90 on the National Stock Exchange.  End
