NCLT admits plea to start insolvency proceeding against Bird Hospitality

NEW DELHI – The Delhi bench of the National Company Law Tribunal on Friday admitted a plea to start insolvency proceeding against Bird Hospitality Services Pvt. Ltd., which operates Roseate Hotels and Resorts and Dusit Bird Hotels Pvt. Ltd., among other properties. The tribunal appointed Atul Kumar Kansal as the interim resolution professional of the debt-ridden company to carry out the functions as per the Insolvency and Bankruptcy Code, 2016.
"We also declare moratorium in terms of Section 14 of the Code," said the tribunal. This means there will be a prohibition on institution of suits against Bird Hospitality Services and the company would be restrained from transferring, encumbering, alienating or disposing of its assets.
According to the order, Bird Hospitality Services has defaulted on making a payment of INR 215.06 million, including interest of INR 7 million. The case has its genesis from late Ankur Bhatia, former director of Bird Hospitality, having extended a loan of INR 277.47 million to the company.
Smriti Bhatia, Saina Bhatia and Arnav Bhatia, the widow, minor daughter and son of Ankur Bhatia, respectively, filed the insolvency petition in the tribunal. According to the petitioners, they were legal heirs of Ankur Bhatia and were collectively entitled to the share of the loan given to Bird Hospitality. The petitioners sought payment of dues from the company and moved the tribunal to start insolvency proceedings. Currently, Radha Bhatia, the mother of Ankur Bhatia, is the director of the company.
