SC stays HC order quashing appointment of India medicine system panel's chief

NEW DELHI – The Supreme Court Tuesday stayed a Delhi High Court order that had quashed the appointment of Vaidya Jayant Yeshwant Deopujari as chairperson of the National Commission for Indian System of Medicine. The top court issued notices to ayurvedic practitioners and former Central Council of Indian Medicine presidents Ved Prakash Tyagi and Raghunandan Sharma who had challenged Deopujari's appointment in the Delhi High Court.

 

The Supreme Court bench of Justices Prashant Kumar Mishra and Manmohan said that it would consider whether Deopujari's Doctor of Philosophy qualification could be treated as an equivalent to the statutory prescribed eligibility qualification of post-graduation for the position of chairman at the medicine body. The Delhi High Court had Friday ruled that Deopujari does not meet the qualifications prescribed for the appointment to the concerned office.

 

"Analysing the alleged experience of Deopujari working in a company producing ayurvedic medicines and products, we are unable to agree with the submission made on behalf of the respondents (the government of India) that such an experience can be said to be one of working as a 'leader' in the capacity of head of a department or an organisation'," the high court had said.

 

Challenging the appointment, Tyagi and Sharma argued that Deopujari does not possess the essential qualifications prescribed under Section 4(2) of the National Commission for Indian System of Medicine Act, 2020. The Delhi High Court also said that Deopujari does not hold a master's degree in any discipline of the Indian system of medicine.

 

As per law, only a person possessing a post-graduate degree in any discipline of the Indian system of medicine from a recognised university, having an experience of not less than 20 years in any field of the Indian system of medicine, including at least 10 years in a leadership role in healthcare delivery, growth and development of the system, or its education, is eligible for the position of chairperson of the National Commission of Indian System of Medicine.  End
