Bombay HC allows Indus Towers to install mobile tower in Maharashtra village

NEW DELHI – The Bombay High Court Friday dismissed claims of potential health risks from radiation from mobile telephony towers and allowed Indus Towers Ltd. to install one such tower in Tanang village in Maharashtra. "...in the modern age, the inescapable reality is that mobile phones are no longer a luxury but an inevitable necessity, be it in the urban areas or in the remotest part of the country," the court said.
To facilitate seamless communication throughout the country and to ensure that citizens living in remote areas are not deprived of the benefits of the revolution in technology which manifests itself in the form of mobile phones, mobile towers cannot be summarily dispensed with on misplaced information, the court said.
The case has its genesis from a resolution adopted by the Tanang gram panchayat in Miraj taluka of Sangli district, cancelling the no-objection certificate granted to Indus Towers to install a mobile tower on a particular plot of land.
The gram panchayat had initially issued the no-objection certificate to Indus Towers. However, after some residents of the village objected to the tower on health grounds, the village council cancelled the certificate.
The petitioner said that after receipt of the no-objection certificate, it had incurred expenses and started civil work to lay the foundation to install the tower. According to the petitioner, about 90% of the work had been completed and the mobile tower was almost ready for operation.
Friday, shares of Indus Towers Ltd. ended 1.7% higher at INR 391.10 on the National Stock Exchange. End
