HC quashes appointment of head of national panel for Indian medicine system

NEW DELHI – The Delhi High Court Friday quashed the appointment of Vaidya Jayant Yeshwant Deopujari as chairperson of the National Commission for Indian System of Medicine. It ruled that Deopujari does not meet the qualifications prescribed for appointment to the office.
"Analyzing the alleged experience of respondent No. 5 (Deopujari) working in a company producing Ayurvedic medicine and products, we are unable to agree with the submission made on behalf of the respondents (the government of India) that such an experience can be said to be an experience of working as a 'leader' in the capacity of 'head of a department' or 'head of an organization'," the court said.
Further, it said Deopujari does not hold a master's degree in any discipline of the Indian system of medicine. The court was hearing petitions filed by ayurvedic practitioners Ved Prakash Tyagi and Raghunandan Sharma challenging Deopujari's appointment. They argued that Deopujari does not possess the essential qualifications prescribed in Section 4(2) of the National Commission for Indian System of Medicine Act, 2020.
As per the law, only a person possessing a post-graduate degree in any discipline of the Indian system of medicine from a recognised university and experience of not less than 20 years in any field of the Indian system of medicine, including at least 10 years in a leadership role in healthcare delivery, growth and development of the system, or its education, is eligible for the chairperson's position.
