HC bars Zydus Green from using name similar to Zydus Life

NEW DELHI - The Delhi High Court on Friday restrained Zydus Green Energy Pvt. Ltd. from using 'Zydus' or any other name deceptively similar to Zydus Lifesciences Ltd.'s registered trademark. Issuing a notice to Zydus Green Energy, the high court appointed a local commissioner for further investigation in the case.
The court noted that the use of 'Zydus' by Zydus Green Energy was "completely unjustified" and the respondent attempted to ride on the goodwill of the petitioner. The court noted that prima facie it was satisfied that it was a fit case for granting an injunction against Zydus Green Energy.
The high court was hearing a trademark infringement suit filed by Zydus Lifesciences against Zydus Green Energy. Zydus Lifesciences is an Indian multinational pharmaceutical company primarily engaged in the manufacturing of generic drugs. Zydus Green Energy was established with the principal aim to tap and develop the renewable energy sources market. Zydus Green Energy deals in services relating to compressed natural gas, compressed bio gas, bio-diesel and ethanol.
In February, Zydus Lifesciences came across Zydus Green Energy's use of 'Zydus' name. Further, Zydus Lifesciences also came across a trademark application filed by Zydus Green Energy with the trademark registry to use using 'Zydus' name on 'proposed to be used' basis. Zydus Lifesciences has also filed an application with the Ministry of Corporate Affairs for rectification of Zydus Green Energy's name in the records.
'Zydus' is an invented word and does not have any dictionary meaning, argued Zydus Lifesciences. The earliest registration of 'Zydus' trademark by Zydus Lifesciences was in 1995. Arguing for its goodwill, Zydus Lifesciences said it has various manufacturing and research facilities in India and business and market in the US and Europe.
At 1413 IST, the shares of Zydus Lifesciences were up 0.4% at INR 928.70 on the National Stock Exchange. End
