NEW DELHI – The Bombay High Court Tuesday quashed the City and Industrial Development Corp. of Maharashtra Ltd.'s work order to a joint venture comprising PNC Infratech Ltd. for integrated infrastructure development of 20 metre and above wide roads and construction of various major and minor structure under Navi Mumbai Airport Influence Notified Area project. The court also quashed the corporation's approval of a financial bid of a joint venture comprising Ashoka Buildcon Ltd. in another tender regarding infrastructure development under the same project.
The court set aside the decision of the corporation's tender committee, in which the latter had rejected the bid submitted by the petitioner Thakur Infraprojects Pvt. Ltd., lead member of a joint venture including OJSC Euro Asian Construction Corp. The high court directed the City and Industrial Development Corporation to consider the financial bids of all the three joint ventures, other eligible bidders and take a decision “afresh” to award the contracts in question.
The decision of the City and Industrial Development Corp. of Maharashtra to reject the technical bids of the petitioner was arbitrary and irrational, said the high court. It also noted a first information report lodged against PNC Infratech for irregularity in integrity pact in respect of a tender. The first information report was not taken into account by City and Industrial Development Corp. of Maharashtra while adjudging the suitability of PNC-Aakshya joint venture's bid, said the high court. Therefore, the decision-making process of City and Industrial Development Corp. of Maharashtra, which led to grant of contracts in favour of respondent joint venture companies cannot be said to be fair, reasonable or transparent, said the high court.
While the tender to PNC Infratech joint venture had a project cost of INR 19.09 billion, the tender involving Ashok Buildcon had the cost of INR 15.69 billion. The petitioner's bid was rejected as it had not signed the integrity pact in breach of the mandatory condition under the tender. Further, mandatory eligibility documents regarding the petitioner were not stamped and signed as required.
On Tuesday, shares of PNC Infratech ended 3.7% lower at INR 254.45 on the National Stock Exchange and those of Ashoka Buildcon ended 4.5% lower at INR 175.89. End
