SC junks plea for probe into Pahalgam attack, says don't demoralise forces

NEW DELHI – Rejecting a petition seeking a judicial probe into the Pahalgam terrorist attack in Jammu and Kashmir, the Supreme Court told the petitioners not to make any prayer that can demoralise the armed forces and the job of judge is not to investigate, but to decide disputes. On Apr. 22, terrorists opened fire on tourists at Baisaran meadow near Pahalgam town in Jammu and Kashmir. At least 26 people were killed in the attack.
"Be responsible before filing such a PIL (Public Interest Litigation). You have some duty towards the country also. This is the way you are trying to demoralise the forces in this hour of crisis and juncture? You are asking a retired Supreme Court judge to investigate. Since when retired High Court, Supreme Court judges have become experts in investigation? Tell us, since when have we required this expertise of investigation? We only decide disputes. Don't ask us to pass an order," said Justice Surya Kant.
The bench, also comprising Justice N.K. Singh, said it was not the time for filing these petitions. This is the crucial hour when each and every citizen of this country has joined hands to fight terrorism, said the top court. "Don't make any prayer which can demoralise our forces...It is not acceptable to us. Look at the sensitivity of the issue," said the top court.
The apex court was hearing a public interest litigation by advocate Fatesh Kumar Sahu and others seeking minimum security standards for tourist sites in areas prone to conflicts, such as Jammu and Kashmir. The petitioners had sought that an action plan be prepared by the Centre, Jammu and Kashmir administration, Central Reserve Police Force, and the National Investigation Agency for the safety of tourists. The petitioners had also sought a judicial probe into the incident by a retired Supreme Court judge. End
