HC notice to CCI on restaurants body seeking document access in Zomato probe

NEW DELHI – The Delhi High Court Monday issued notice to the Competition Commission of India on a petition by the National Restaurants Association of India seeking access to confidential documents from the probe of the anti-trust regulator's director general into Eternal Ltd. A similar petition was filed by the association in November seeking access to documents from the probe into Swiggy Ltd.
In its interim prayer, the association said the Competition Commission of India should review the confidentiality claims of Zomato, which has changed its name to Eternal. The court will now hear the cases filed by the association against both Eternal and Swiggy on Wednesday.
In 2021, the association had submitted some information against the two companies alleging anti-competitive behaviour. In 2022, the competition commission said a prima facie case had been made out and ordered a probe by the director general into the actions of the companies. Swiggy gave "highly confidential" information to the director general. The investigation was completed in March 2024.
Thereafter, Swiggy and Zomato filed applications seeking confidential versions of the director general's findings. The association also sought the confidential versions of the director general's probe against the two companies. However, the Competition Commission of India removed the association from the confidential ring, after which the latter moved the Delhi High Court.
On Monday, shares of Eternal ended 1.1% higher at INR 234.24 on the National Stock Exchange, while shares of Swiggy ended 0.9% higher at INR 343.85. End
