--HC bars Palsons Derma from selling pdts similar to FDC's 'Kromalite'
NEW DELHI – The Delhi High Court on Tuesday restrained Palsons Derma Pvt. Ltd. from manufacturing, selling or dealing with any products under the name 'Chromalite' or any other name similar to FDC Ltd.'s trademark 'Kromalite' till final adjudication of suit. FDC is the registered user of the trademark 'Kromalite' for its skin-brightening creams.
The balance of convenience is in favour of FDC, which has been using the Kromalite trademark since April 2016, whereas Palsons Derma has admittedly launched its products under the mark only in September 2022, the high court said. FDC will suffer irreparable loss, harm and injury if Palsons Derma is permitted to carry on its business under the 'Chromalite' name, the court said.
FDC trades in over 300 products in India and exports to over 50 countries and had an annual revenue of INR 17.77 billion in 2022-23 in India. FDC adopted the mark 'Kromalite' in 2014 and commercially launched the product in 2016. FDC's audit sales figure shows that Kromalite had net sales of INR 11.86 million in 2022-23.
In 2023, FDC came across Palsons Derma's registrations for the mark 'Chromalite' on a 'proposed to be used' basis. Consequently, FDC issued a cease-and-desist notice to Palsons Derma in 2023. FDC filed a permanent injunction suit against Palsons Derma in the high court as it did not receive any reply from Palsons Derma.
On Tuesday, shares of FDC ended 0.8% higher at INR 425.00 on the National Stock Exchange. End
