SC notice to Maharashtra on Grauer & Weil's plea against mall closure order

NEW DELHI – The Supreme Court has issued notices to the Maharashtra government and the Maharashtra Pollution Control Board on an appeal by Grauer & Weil (India) Ltd. against a Bombay High Court order to uphold closure of the company's Growel's 101 Mall in the western suburb of Kandivali in Mumbai. The apex court will hear the case next on Apr. 21.
On Mar. 5, the regional officer of the pollution control board, Mumbai, had ordered closure of the mall on the grounds that Grauer & Weil had completed its construction without obtaining prior environmental clearance and consent to establish or operate it. In its appeal, the high court had said on Mar. 19, "Operating a mall that is put up without obtaining any environmental clearance is extremely serious and operating such a mall without obtaining consent to establish/operate magnifies the seriousness of the ecological issue."
Grauer & Weil said that the mall has been operational since 2010 and employs about 1,900 persons. Critically, this mall has not faced any complaints of environmental or ecological issues since its inception, the petitioner said. It added that the mall was being shut down without complaints of pollution and that too, without hearing its side of things.
The closure order will have far-reaching consequences that would imperil the livelihood of all employees, said Grauer & Weil. The high court failed to appreciate that the closure order was issued despite the fact that the petitioner had applied for the environmental clearance and the consent to establish under relevant amnesty schemes, the petitioner said.
On Wednesday, shares of Grauer & Weil ended 2.1% lower at INR 82.78 on the National Stock Exchange. End
