SC summons road secy for not bringing scheme to treat accident victims

NEW DELHI – The Supreme Court on Wednesday summoned the secretary of the Ministry of Road Transport and Highways to explain the failure on the part of the government in not bringing a scheme for cashless treatment of victims of road accidents during the "golden hour", including provisions for the creation of funds for the treatment. The court had given the government time till Mar. 14 to bring the scheme.
"According to us, this is a very serious breach and violation of not only the order of this court but it is a case of failure to implement a very beneficial provision in the statute," said a bench of Justice Abhay S. Oka and Justice Ujjal Bhuyan.
The court said it will issue a notice of contempt of court if it finds that the government has made no progress. People are losing their lives because there is no treatment, the apex court said. "Let the secretary come and explain. Otherwise, we are putting it on notice that we will take action again under the Contempt of Courts Act," the court said.
After the lawyer for the government said that it would bring the scheme and there were some bottlenecks, the top court observed: "It has been our long experience, only when we get top government officials here then they take the orders of the court seriously. Otherwise they won't take it". The apex court will now hear the case on Apr. 28.
The court on Jan. 8 asked the government to bring a scheme and place it on record along with an affidavit from the concerned officer of the Ministry of Road Transport and Highways explaining how the scheme will be implemented. Golden hour refers to the first hour following an accident when the likelihood of preventing death is the highest by providing prompt medical care. End
