Waqf Amendment Act comes into force, says govt

NEW DELHI – The Ministry of Minority Affairs issued a notification stating that the Waqf (Amendment) Act 2025, which was enacted by Parliament during the Budget session, has come into effect from Tuesday. On Saturday, President Droupadi Murmu accorded assent to the act which amended the law for administration of waqf properties in the country.
The Waqf (Amendment) Bill 2025 was passed by the Rajya Sabha on Friday, nearly 24 hours after it was passed by the Lok Sabha. It amended the Waqf Act, 1995 and sought to bring about significant changes in the administration and management of waqf properties. It curbed the powers of the Waqf Board and empowered the central government to make rules pertaining to asset management and administration. The 2025 act sought to omit Section 40 of the Waqf Act, which empowered the board to decide if a property was a waqf property. It also sought to streamline the registration of waqfs through a central portal and database. It further allowed the appointment of non-Muslims in the Central Waqf Council, state waqf boards, and waqf tribunals.
Following the parliamentary approval, a batch of petitions was filed in the Supreme Court by the leaders of Indian National Congress, All India Majlis-e-Ittehadul Muslimeen and Dravida Munnetra Kazhagam among others against the act. The petitioners submitted that act was discriminatory towards Muslim community and violated their fundamental rights. End
