NEW DELHI – Days after a huge pile of cash was allegedly recovered at the residence of Delhi High Court judge Yashwant Varma, the government on Friday approved the Supreme Court collegium's recommendation to transfer him to Allahabad High Court. "In exercise of the power conferred by clause (1) of Article 222 of the Constitution of India, the President, after consultation with the Chief Justice of India, is pleased to transfer Shri Justice Yashwant Varma, Judge, Delhi High Court, to be a Judge of Allahabad High Court and to direct him to assume charge of his office in the Allahabad High Court," said the government notification.  

 

The Supreme Court on Saturday had formed a three-member committee to conduct an enquiry into allegations that a huge pile of cash was found at Justice Yashwant Varma's residence after a fire broke out at his place. When the fire broke out, Justice Varma was not in town and his family members called the fire brigade, which found the cash and later, the police were informed. 

 

It is to be noted that the Allahabad High Court Bar Association had previously opposed Justice Varma's transfer, stating they were not a "trash bin". On Monday, the association called for a review of all judgments made by Justice Varma during his tenure at the high court and demanded immediate action for his impeachment. On Tuesday, the association had even begun a strike contesting the transfer of Justice Varma to the Allahabad High Court.

 

Earlier, Delhi High Court Chief Justice Devendra Kumar Upadhyaya had initiated an in-house inquiry. According to his report, half-burnt cash was found in sacks in the room where the fire had started. The Supreme Court later uploaded photographs and videos of the burnt cash on its website.

 

According to the report, the inquiry found no evidence suggesting that anyone other than the residents of the bungalow, the servants, gardeners, and possibly Central Public Works Department personnel had access to the room. Based on this, Delhi High Court Chief Justice Upadhyaya concluded that, prima facie, the matter required a more thorough investigation. After receiving the report, Chief Justice Khanna directed Justice Varma to explain the presence of the cash in the room, its source, and who had removed it. In his response, Justice Varma said that after the fire was extinguished and he returned to the scene, he found no cash or currency at the location. He denied placing cash in that storeroom, either personally or by any of his family members, and strongly rejected the suggestion that the cash in question belonged to him.  End
