SC stays till Wed probe against Madhya Pradesh RERA chief in corruption case

NEW DELHI – The Supreme Court on Thursday stayed an inquiry against Madhya Pradesh Real Estate Regulatory Authority's Chairperson Ajeet Prakash Shrivastava on alleged complaint of corruption, misuse of official position, and regulatory violations, till Wednesday, the next date of hearing. The top court issued notices to Madhya Pradesh government and others on a petition filed by Shrivastava and Madhya Pradesh Real Estate Regulatory Authority.

 

Shrivastava had sought directions for quashing the inquiry proceedings against him, which were pending before the inquiry committee constituted by the Madhya Pradesh High Court. Shrivastava has asked for complete records in relation to the inquiry proceedings against him.

 

Advocate Shyam Divan, appearing for Shrivastava, said that the inquiry had been initiated in complete disregard and violation to the procedure prescribed under Rule 35 of the Madhya Pradesh Real Estate (Regulation and Development) Rules, 2017 and other provisions of the Real Estate (Regulation and Development) Act, 2016.

 

Last year, the Economic Offences Wing had started a probe against Shrivastava on a complaint which alleged that he had manipulated the recruitment process for various Real Estate Regulatory Authority positions. The complaint said that out of two sanctioned posts for adjudication officers, only one was advertised, while the other was filed without a public notice. Further, it was alleged that Shrivastava had overlooked the age requirements for contractual appointments, which mandated a maximum age of 65 years, by appointing individuals older than this limit.

 

Thereafter, the state government wrote to the high court's chief justice, who appointed Justice Maninder Singh Bhatti to probe the allegations. Justice Bhatti issued a notice to Shrivastava and sought for his reply by Friday.  End
