After mediation fails, HC to hear Tesla Inc trademark suit vs Tesla Power

NEW DELHI – The Delhi High Court will hear electric vehicle giant Tesla Inc.'s trademark infringement suit against Gurugram-based Tesla Power India Pvt. Ltd. on Apr. 15 after mediation proceedings between the parties failed.

 

Tesla Inc., an American multinational automotive and clean energy company, had moved court in May last year and said that Tesla Power's use of 'Tesla' trademark in India was causing confusion among consumers and potentially harming its business interests. Tesla Inc. said consumers were mistakenly buying Tesla Power's batteries assuming they were associated with the American company and thereafter registering complaints with them. 

 

Tesla Power said it was not manufacturing electric vehicles but only selling lead acid batteries for automobiles and inverters. In the hearing on May 2, Tesla Power Chief Executive Officer Kavinder Khurana had submitted to the court that the company had no plans to enter the electric vehicle market and the advertisements featuring the Tesla trademark were related to another company, e-Ashwa, with which it has a strategic partnership to sell branded products. Khurana's statement came after Tesla Inc.'s advocate Chander Lall had said Tesla Power was advertising its batteries in national dailies using the Tesla logo.

 

However, Tesla Inc., on May 28, had said that despite an undertaking by Tesla Power, electric scooters were sold by the Gurugram company through dealers under various sub-brands. The court had then asked Tesla Power to file an affidavit on the number of electric scooters sold and the current stocks available with them. 

 

On May 30, Tesla Power India told the court that it had written to its vendors and partners to remove the Tesla marks on the electric scooters. Tesla Power had said, "We don't wish to sell anything beyond the undertaking." The Gurugram company said that emails were sent to all its franchises to not sell anything under the company's brand and remove them accordingly. 

 

In February, media reports said that Tesla Inc. had begun scouting for land to set up an electric vehicle plant in India. Maharashtra is the company's first preferred destination after the government had offered sites near Pune, where it already has an office, stated the reports.  End
