On BharatPe's injuction suit, Delhi HC temporarily bars use of Bharat Pay app, website

NEW DELHI – The Delhi High Court on Tuesday temporarily barred the use of the Bharat Pay application and website following a permanent injunction suit filed by Resilient Innovations Pvt. Ltd., a company operating under the brand name BharatPe. Issuing summons to the defendants, the high court said the use of the domain name and mobile application by them would result in misleading and defrauding innocent members of the public and cause financial losses.
The high court said the balance of convenience lies in favour of Resilient Innovations and irreparable harm and injury would be caused to them if an injunction order wasn't passed. The high court asked GoDaddy to suspend the domain name of Bharat Pay.
Resilient Innovation moved the high court after seeing a mobile application by the defendants in January, similar to their trademark BharatPe. The defendants have no connection with BharatPe and the location mentioned in their website is of a street vendor, said Resilient Innovation.
Bharat Pay was operating in the same financial services business as the petitioner, said Resilient Innovation. The defendants were offering direct-to-home recharges, mobile recharges and had bill payment systems, the petitioner said. Resilient Innovation said it was serving 150 cities and had a huge amount of monthly Unified Payments Interface transactions. End
