SC collegium recommends transferring Delhi HC judge Varma to Allahabad HC

NEW DELHI – Days after a huge pile of cash was allegedly recovered at the residence of Delhi High Court judge Yashwant Varma, the Supreme Court's collegium recommended his transfer to the Allahabad High Court Monday. On Saturday, the top court had formed a three-member committee to conduct an inquiry into the allegations against Justice Varma and asked Delhi High Court Chief Justice Devendra Kumar Upadhyaya not to assign any judicial duties to him for the time being.
"The Supreme Court Collegium in its meetings held on 20th and 24th March 2025 has recommended repatriation of Justice Yashwant Varma, judge, High Court of Delhi, to the High Court of Judicature at Allahabad," said the collegium in its resolution. It is to be noted that the Allahabad High Court Bar Association had previously opposed Justice Varma's transfer, stating they were not a "trash bin". On Monday, the association called for a review of all judgments made by Justice Varma during his tenure at the high court and demanded immediate action be taken for his impeachment.
On Mar. 14, a large sum of cash was found at Justice Varma's bungalow following a fire at his residence. At the time of the fire, Justice Varma was out of town, and his family members had called the fire brigade, who reportedly found the cash and notified the police.
Thereafter, Delhi High Court Chief Justice Upadhyaya initiated an in-house inquiry. According to his report, half-burnt cash was found in sacks in the room where the fire had started. The Supreme Court later uploaded photographs and videos of the burnt cash on its website.
According to the report, the inquiry found no evidence suggesting that anyone other than the residents of the bungalow, the servants, gardeners, and possibly Central Public Works Department personnel had access to the room. Based on this, Delhi High Court Chief Justice Upadhyaya concluded that, prima facie, the matter required a more thorough investigation. After receiving the report, Chief Justice Khanna directed Justice Varma to explain the presence of the cash in the room, its source, and who had removed it. In his response, Justice Varma said that after the fire was extinguished and he returned to the scene, he found no cash or currency at the location. He denied placing cash in that storeroom, either personally or by any of his family members, and strongly rejected the suggestion that the cash in question belonged to him. End
