NEW DELHI – The Supreme Court Friday said that the transfer of Delhi High Court judge Yashwant Varma was independent of the inquiry against him in the issue relating to huge pile of cash found at his residence. The court said there was misinformation and rumours being spread with regard to the incident.

 

According to a news report in The Times of India published on Friday, a huge pile of cash was found at Justice Varma's bungalow after a fire broke out at his residence. When the fire broke out, Justice Varma was not in town and his family members had called the fire brigade, who found the cash, and later police were also informed. The news report said that following the recovery of the cash, the collegium of Supreme Court proposed transferring Justice Varma to Allahabad High Court. 

 

The Supreme Court said that the Delhi High Court Chief Justice Devendra Kumar Upadhyaya, on receiving the information, commenced an in-house enquiry, collecting evidence and information. Chief Justice Upadhyaya had started the enquiry even before the top court's collegium met on Thursday, said the apex court.

 

Delhi High Court Chief Justice Upadhyaya will submit his report to Chief Justice of India Sanjiv Khanna on Friday, said the top court. The report will be examined and processed for further and necessary action, the court added.

 

The Supreme Court said that the proposal to transfer Justice Varma to Allahabad High Court was examined by the collegium comprising Chief Justice Khanna and four senior most judges of the apex court on Thursday. Thereafter, letters were written to the consultee judges of the Supreme Court, the chief justices of the high courts concerned and Justice Yashwant Varma, said the apex court. Responses received will be examined and, thereupon, the collegium will pass a resolution on the transfer, the top court added.

 

Earlier in the day, Congress leader Jairam Ramesh had raised in the Rajya Sabha the issue of recovery of cash at the residence of Justice Varma and requested Chairman Jagdeep Dhankhar to give direction to the government to take steps towards increasing judicial accountability. Dhankhar told the house that he will find a mechanism for a structured discussion on the issue during the session.

 

Justice Varma had enrolled as an advocate in 1992 and practised matters relating to constitutional, labour and industrial legislations, corporate laws, taxation and allied branches of law. He was a special counsel for the Allahabad High Court from 2006 till his elevation as a judge in 2014, when he became an additional judge. In 2016, Justice Varma took oath as the permanent judge in the Allahabad High Court and in 2021 he was transferred to Delhi High Court.  End
