Tax revenue of nearly INR 18 tln locked up in litigation, says Sitharaman

NEW DELHI – Nearly INR 18 trillion of tax revenue is locked up in litigation across various courts in India, Finance Minister Nirmala Sitharaman told the Parliament on Tuesday.
According to data presented by Sitharaman in the Rajya Sabha, 82,011 cases related to disputes on indirect tax were pending in courts and tribunals as on Jan. 31, with a total of INR 5.76 trillion locked up in these cases. Similarly, 71,453 cases of direct tax disputes involving INR 11.84 trillion were pending in courts as on Dec. 31.
Sitharaman said that the government had taken various steps to resolve both indirect and direct tax disputes. The Direct Tax Vivad se Vishwas Scheme was launched in October as a one-time measure of dispute resolution. "As per the scheme, the appellant, in whose case objections before DRP/ appeal/writ petition/ special leave petition has been filed by him or by the Income Tax Authority or both, can avoid litigation by paying the amount, decided by the designated authority as per the Scheme," Sitharaman said in a written reply.
The government also increased the monetary limits for filing appeals in various fora with respect to legacy, customs & goods and services tax appeals. "Consequent to enhanced monetary limits, total 200 Legacy Appeals & 14 Customs Appeals have been dismissed (as withdrawn) on account of monetary limits by the Hon'ble Supreme Court," the finance minister said.
