Lok Sabha passes Bills of Lading Bill to replace 1856 Act

NEW DELHI – The Lok Sabha on Monday passed the Bills of Lading Bill, 2024, which will replace the Indian Bills of Lading Act, 1856. The law provides a legal framework for the issuance of bills of lading. It also refers to a document issued by a freight carrier to a shipper.
A bill of lading is a legal document issued by a carrier to the shipper. It contains details about the goods being shipped, where the shipment is coming from and where it is going, and details of the shipper, carrier, and consignee.
The 1856 law, while containing details such as the type, quantity, condition, and destination of goods being carried, also states that a bill of lading is conclusive evidence of goods on board. While retaining all the provisions of the old law, the new one grants all rights of suit and liabilities regarding the goods to the receiver or any third party to whom the receiver may transfer ownership of the goods.
"Though the substantive aspects of the Act continue to remain relevant, being a pre-Independence statute, it is imperative that the provisions of the said Act require to be revisited without changing the substance or spirit of the said Act, so as to bring it in line with modern legislations in order to facilitate simplification and ease of understanding," said Minister of Ports, Shipping, and Waterways Sarbananda Sonowal in the statement of objects and reason of the bill.
