--HC sends Dabur, Patanjali to mediation in toothpaste trade dress case
--CONTEXT: Dabur in HC against Patanjali Ayurved's Dant Kanti Red toothpaste
NEW DELHI – The Delhi High Court on Friday sent Dabur India Ltd. and Patanjali Ayurved Ltd. to mediation in the Delhi High Court Mediation and Conciliation Centre on a dispute over toothpaste trade dress. Dabur India had moved the high court alleging that Patanjali Ayurved's Dant Kanti Red toothpaste with pan flavour has a similar trade dress as its product Red toothpaste. Patanjali Ayurved is the parent company of Patanjali Foods Ltd.
The court passed the order after both the parties agreed that the case could proceed through mediation. The high court said that the mediation centre will hear the case on Feb. 4 and listed the case for hearing on Mar. 20.
Trade dress is the characteristic of the visual appearance of a product or its packaging that signifies the source of the product to consumers.
Dabur and Patanjali are also involved in a dispute where the former had sought a permanent injunction on the airing of a television commercial on Chyawanprash products by Patanjali which was disparaging Dabur and defaming its products.
On Friday, shares of Dabur India ended 0.7% lower at INR 529.85 on the National Stock Exchange, while those of Patanjali Foods closed 0.8% lower at INR 1,824.60. End
