Pay INR 3 mln or face injunction, HC to Vels Film on Saregama copyright suit

NEW DELHI – In response to a copyright infringement lawsuit filed by Saregama India Ltd. regarding the song "En Iniya Pon Nilave," the Delhi High Court Thursday directed Vels Film International Ltd. to either deposit INR 3 million or face an injunction preventing the use of the song in their film "Aghathiyaa". Vels Film's counsel informed the court that the company was prepared to accept the injunction.

 

Saregama India argued that Vels Film had adapted, recorded, and released the song from the 1980 film "Moodu Pani" for promotional purposes in Aghathiyaa without obtaining authorisation or a licence from the plaintiff. "Aghathiyaa" is an upcoming Tamil-language period horror thriller written and directed by Pa. Vijay, and produced by Ishari K. Ganesh under the Vels Film International banner.

 

Saregama India said that in 1980 the producer of the film "Moodu Pani", Raja Cine Arts, entered into an agreement with the plaintiff. As a result, the copyright for the sound recordings and the musical and literary works of the film's songs were transferred to the plaintiff, according to Saregama India. The company further explained that it is involved in acquiring copyrights for sound recordings and the literary, musical, and dramatic works contained within them, as well as distributing, selling, and exploiting these rights through various platforms and media.

 

At 1238 IST, shares of Saregama India were down 2.7% at INR 475.50 on the National Stock Exchange while shares of Vels Film were up 5.0% at INR 47.65.  End
