Bengal govt plea on death penalty to Sanjay Roy not maintainable - CBI to HC

NEW DELHI – The Central Bureau of Investigation on Wednesday said that the West Bengal government's appeal in the Calcutta High Court against life imprisonment to convict in RG Kar Hospital case was not maintainable. The state government had sought death penalty for Sanjay Roy, a civic volunteer who was convicted Saturday for rape and murder of a 31-year-old junior doctor at RG Kar Medical College and Hospital.
The counsel for the state government said law and order was a state subject and the first information report was lodged by the state police. Also, that the probe was transferred by the high court to CBI. "The state govt is primarily responsible for the investigation. They cannot be construed to be a bystander," said the counsel for the state government. The counsel for CBI questioned how the state can appeal for the maximum punishment for the convict. "If the victim's family, the CBI or the convict have not approached the high court, how can the state file this appeal?" The high court will hear the case next on Jan. 27.
The junior doctor was found dead at the seminar hall of the RG Kar Medical College and Hospital in Kolkata on Aug. 9. Police had, thereafter, arrested Roy in connection with the case. The gruesome incident led to protests and strikes by doctors across several cities demanding justice. On Aug. 13, the Calcutta High Court had transferred the probe to the CBI.
In October, the probe agency had filed a chargesheet against Roy under Sections 64, 66, 103(1) of the Bharatiya Nyaya Sanhita. It had sought the harshest punishment for Roy, presenting evidence, including closed-circuit television camera footage, which indicated his presence near the crime scene. On Monday, an additional district court at Sealdah in Kolkata had sentenced Roy to life imprisonment and rejected CBI's plea for death penalty, saying it was not the rarest of rare cases. End
