Noida Toll Bridge moves plea to review of SC order barring DND flyway toll

NEW DELHI – Noida Toll Bridge Co. Ltd. has moved the Supreme Court seeking a review of the apex court order in December barring the company from collecting the toll on the DND flyway between Delhi and Noida in Uttar Pradesh.
In December, the apex court had said that Noida overstepped its authority by delegating powers to Noida Toll Bridge Co. to collect tolls or levy user fees, and this was alien to the terms of the concession agreement. There was no reason for the collection of the user or toll fee to continue, the court had said. The court held Article 14 of the concession agreement between Noida, Noida Toll Bridge and Infrastructure Leasing & Financial Services Ltd. was invalid.
The case has its genesis in the Noida authority signing an agreement with Noida Toll Bridge to construct a 9.2-kilometre eight-lane flyover from Noida to South Delhi under a build-own-operate-transfer model. Noida Toll Bridge was promoted by Infrastructure Leasing & Financial Services.
Initially, Noida Toll Bridge charged a toll of INR 8 per car, which was hiked to INR 22 and then to INR 25 in 2012. Aggrieved by the increasing toll, the Federation of Noida Residents Welfare Associations moved the Allahabad High Court against the toll. The court barred the Noida Toll Bridge from collecting the toll on the flyway.
On Monday, the shares of Noida Toll Bridge ended 1.2% lower at INR 6.85 on the National Stock Exchange. End
