SC stays proceedings against Rahul Gandhi over remarks on BJP, Amit Shah

NEW DELHI – The Supreme Court on Monday stayed the trial court's proceedings against Congress leader and Member of Parliament Rahul Gandhi over his alleged remarks that Bharatiya Janata Party members were "liars" and "drunk with power" and Union Home Minister Amit Shah was a "murder-accused". The apex court issued notices to the state of Jharkhand and BJP worker Navin Shah on Gandhi's plea against a Jharkhand High Court order refusing to quash the Congress leader's defamation case.
The case has its genesis in Navin Shah filing a complaint against Gandhi, saying that the latter made defamatory remarks against the BJP and Amit Shah at the party's plenary session in 2018. In 2018, a magistrate's court in Ranchi had said that a prima facie case was made out against Gandhi and issued "process" for his appearance. In the Code of Criminal Procedure, the term "process" refers to the steps taken to call an accused to appear in court.
Hearing an appeal against the magistrate's order, the Jharkhand High Court had said that Navin Shah, being a BJP worker, had "locus standi" to file the complaint case under Sections 499 and 500 of the Indian Penal Code. "It appears that prima facie case under Sections 499/500 of the Indian Penal Code is made out against the petitioner Mr. Rahul Gandhi for imputing the Bharatiya Janata Party leadership as liars and drunk with power," the high court had said in February 2024.
