SC stays order asking Delhi to sign Mou with Centre for health infra scheme

NEW DELHI – The Supreme Court on Friday stayed a Delhi High Court order asking the Delhi government to sign a memorandum of understanding with the Centre by Jan. 5 for implementing the PM–Ayushman Bharat Health Infrastructure Mission scheme in the National Capital Territory. The apex court issued notices to the Centre, All India Institute of Medical Sciences and listed the case for hearing on Feb. 18. 

 

Advocate Abhishek Manu Singhvi, appearing for the Delhi government, said that the powers of the Centre in Delhi were limited to matters under the state list relating to public order, police and land. However, the Delhi High Court, through its order in December, had redefined the powers of the Centre to include the health sector, Singhvi said.

 

Singhvi contested the high court was forcing the Delhi government to sign the memorandum of understanding, which is a policy decision. Singhvi said the reach and coverage of the Delhi government's Delhi Arogya Kosh scheme was much larger. The high court had asked the Delhi government to sign the memorandum of understanding.

 

Hearing a suo motu case regarding the availability of intensive care unit beds and ventilator facilities in government hospitals, the high court said that the scheme would have to be implemented to ensure that the residents of Delhi were not deprived of the funds and facilities. The non-implementation of the scheme in Delhi, when 33 states and Union territories have already implemented the same, would not be justified, the high court had said. 

 

Announced in 2021, the PM–Ayushman Bharat Health Infrastructure Mission scheme focuses on developing capacities of health systems and institutions at all levels -- primary, secondary and tertiary -- and on preparing health systems to respond effectively to current and future pandemics and disasters.   End
