NCLT Mumbai contractual, outsourcing staff strike work over pay issues

NEW DELHI – All contractual and outsourced staff of the Mumbai bench of the National Company Law Tribunal have struck work on salary issues. In a memorandum, the staff said that with effect from Tuesday, they will refrain from performing their professional obligations until their grievances are addressed through the appropriate channels.
Among the reasons for the strike are non-payment of salaries for December, irregular and delayed payment of salaries for at least six months, and no revision of salaries since the bench was set up in 2016. In all, 156 staff members have struck work, including 86 contractual and 70 outsourced staff.
Advocate Ashish Pyasi, founding partner at Aendri Legal, said the Mumbai bench of the tribunal could not function properly as a result of the strike and had to give new dates for its cases. "Without the staff who will prepare orders, get the files?" said Pyasi. If the strike continues, it will be a problem for litigants and lawyers will also be affected, he said. On a possible solution to end the strike, Pyasi said "timely release of salaries will definitely help".
The Mumbai bench of the tribunal Tuesday was dealing with cases relating to Jet Airways (India) Ltd., Infrastructure Leasing and Financial Services Ltd., Future Retail Ltd., and others. All of these had to be adjourned on account of the strike.
The National Company Law Tribunal is a quasi-judicial body that adjudicates disputes arising from the Companies Act, 2013, and the Insolvency and Bankruptcy Code, 2016. It has 16 benches in cities such as Mumbai, Delhi, Bengaluru, and Ahmedabad.
Last week, the Ministry of Corporate Affairs had appointed 24 new judicial and technical members to the tribunals. The appointments came following concerns raised by the apex court regarding significant vacancies in the National Company Law Tribunals and National Company Law Appellate Tribunals. End
