HC junks Gensol Electric plea to restrain M&M arm from selling e-ZEO EV

NEW DELHI – Rejecting an interim injunction plea by Gensol Electric Vehicles Pvt. Ltd., the Delhi High Court on Monday refused to restrain Mahindra & Mahindra Ltd.'s subsidiary Mahindra Last Mile Mobility Ltd. from selling its commercial electric four-wheeler e-ZEO. "The applicant (Gensol Electric Vehicles) has failed to make a case for interim injunction. The application is dismissed," the court said.
"It is also an undisputed position that the vehicles of the defendant (Mahindra Last Mile Mobility) and the plaintiff (Gensol Electric Vehicles) belong to a different category and are targeted at a different segment of the public," the high court said. Gensol Electric's vehicle is an electric passenger vehicle, whereas Mahindra Last Mile Mobility's vehicle is an electric commercial vehicle. Naturally, their shape, size and configuration as well as prospective customers would be different, the court said.
"...in the present case, the likelihood of confusion is remote as the plaintiff (Gensol Electric Vehicles) has not even started selling its vehicle," the court said. Balance of convenience is also in favour of Mahindra Last Mile Mobility for not granting interim injunction at this stage, as the company has already launched its product whereas Gensol Electric Vehicles is yet to launch its product in the market, said the court.
The high court was hearing a permanent injunction suit filed by Gensol Electric Vehicles against Mahindra Last Mile Mobility. Gensol Electric had said it owned the trademark "eZio" and Mahindra Last Mile Mobility's usage of "e-ZEO" would confuse the public.
In October, Mahindra Last Mile Mobility had announced the official launch of Mahindra e-ZEO, a revolutionary new electric four-wheeler. The name "ZEO" stands for "Zero Emission Option", and displays the environmental benefits of the electric vehicle. Available in two variants, the Mahindra e-ZEO was specifically engineered to meet the evolving demands of urban logistics. The company had priced the Mahindra e-ZEO starting INR 752,000 rupees, ex-showroom, pan-India.
Gensol Electric Vehicles, a subsidiary of Gensol Engineering Ltd., will launch its first electric vehicle "eZio" at the Bharat Mobility Global Expo 2025 later this week. Gensol Electric had said eZio will offer a claimed range of up to 200 km on a full charge and will reach a top speed of 80 kmph, with the car receiving Automotive Research Association of India certification in February. The electric vehicle is expected to cater to the company's cab service available in cities like Delhi, Bengaluru, and Mumbai.
At 1328 IST, the shares of Mahindra & Mahindra Ltd. were down 2.1% at INR 3,029 on the National Stock Exchange, while the shares of Gensol Engineering were down 4.3% at INR 716. End
