Delhi HC summons Dabur India on plea by Capital Foods in trademark suit

NEW DELHI – The Delhi High Court on Friday issued summons to Dabur India Ltd. on a trademark infringement suit filed by Tata Consumer Products Ltd.-owned Capital Foods Ltd. regarding its "Schezwan Chutney" trademark. Capital Foods said that Dabur India through its "Hommade schezwan chutney" product was infringing its registered trademark.

 

Objecting to Dabur India's product name, Capital Foods said that consumers automatically relate to its product, which is marketed as Ching's Schezwan Chutney, when they see a product named Schezwan Chutney. Capital Foods said it also holds a copyright for the unique design of its products and has taken legal action in the past against entities misusing its trademark.

 

Dabur India's packaging has Schezwan Chutney written in big font, said Capital Foods, adding that the former was downplaying their own brand name. Dabur India was misleading consumers into thinking that their product is associated with or endorsed by Capital Foods, said the petitioner.

 

On Friday, shares of Dabur India closed 0.6% lower at INR 517.90 on the National Stock Exchange.  End
