HC seeks Patanjali Ayurved's reply on Dabur's plea in disparagement case

NEW DELHI – The Delhi High Court on Friday sought a response from Patanjali Ayurved Ltd. on a fresh application by Dabur India Ltd., seeking an interim injunction against the parent company of Patanjali Foods Ltd. for airing television commercials on Chyawanprash products which were disparaging the petitioner and defaming its products. The high court will hear the case next on Jan. 20.
On Dec. 24, the high court had issued summons to Patanjali Ayurved on Dabur India's plea. The court had also issued notice to Patanjali Ayurved on Dabur's plea for interim injunction. However, after issuance of summons, Patanjali Ayurved ran 6,182 advertisements against its product in the last one week, said Dabur India.
Dabur India said the advertisements incorrectly claimed Patanjali Ayurved's product was made using more than 51 herbs. Patanjali Ayurved is using only 47 herbs, said Dabur India, adding that it was "misinformation to the public at large". The petitioner said that Patanjali Ayurved has specifically referred to Dabur's product made with using 40 herbs as ordinary. "They refer to us as ordinary. They make a market leader ordinary," said Dabur India, adding that it holds a dominant 61.6% market share in the Chyawanprash segment. Further, Dabur India said that Patanjali was using mercury in its Chyawanprash product, which was not fit for consumption of children.
On Dec. 24, Dabur India had highlighted Patanjali Ayurved's commercial which said that those who lack knowledge of Ayurved and Vedic traditions cannot produce the "original" Chyawanprash. Dabur India had said that statement implied that only Patanjali Ayurved's product was authentic, while other brands were inferior or fake.
At 1320 IST, the shares of Dabur India traded down 0.4% at INR 519.30 on the National Stock Exchange, while the shares of Patanjali Foods traded down 2.1% at INR 1,820.
