NEW DELHI – The Supreme Court on Thursday termed the functioning of Allahabad High Court as "worrisome" after the bench was informed by a petitioner that the court had not taken up a matter for hearing despite directions by the apex court to consider the case expeditiously. The top court made the remark while hearing a plea regarding the ownership of a property at Jiamau in Lucknow.
The bench ordered officers from the Uttar Pradesh government to maintain status quo on the property, over which the sons of late Uttar Pradesh gangster-turned politician Mukhtar Ansari had staked claim, till the high court hears the case.
"Some of the high courts, we don't know what will happen...this (Allahabad High Court) is one of the high courts which one should be worrisome about. Unfortunately, filing has collapsed, listing has collapsed...Nobody knows which matter will be listed," said Justice Surya Kant. The bench, also comprising Justice N. Kotiswar Singh, said the apex court was still hopeful that the matter will be listed before the appropriate bench of the high court at the earliest. The court asked its registry to send a copy of its current order to the high court's registrar, who will bring to the bench's notice its order for early listing of the case.
In 2020, the Lucknow Development Authority had demolished a bungalow built on a piece of land at Jiamau in order to build flats there under the Pradhan Mantri Awas Yojana. Mukhtar Ansari's son had moved the apex court after the Allahabad High Court had not listed his application for an interim stay on any construction or demolition on the property, despite directions by the top court in October to take it up.
