Delhi HC temporarily bars entities from using 'Upstox' trademark

NEW DELHI – The Delhi High Court on Tuesday temporarily barred entities from using "Upstox" or any similar name till the next hearing of the trademark infringement suit filed by RKSV Securities India Pvt. Ltd. The high court issued summons and notices to the parties listing the case for hearing in May.
The high court noted that RKSV Securities India, also known as Upstox, has shown a prima facie case for grant of an interim injunction. If the injunction is not granted, it will cause irreparable harm to RKSV Securities, said the court.
RKSV Securities, incorporated in 2009, is an online brokerage company that offers a variety of services, including stock, mutual fund and initial public offering trading. The counsel for RKSV Securities said that people have been duped of money in the name of its Upstox. These entities formed multiple WhatsApp and Telegram groups using Upstox's name, said the counsel.
The counsel also took the court through the deposit slips by the customers who had thought they had invested money through real Upstox. These entities are available in the application store and play store of both iPhone and android operating system, said the counsel. End
