NEW DELHI – The Delhi High Court Monday restrained some entities from using Reliance Retail Ltd.'s "Reliance", "Campa" and "Campa Cola" trademarks till the next hearing on May 19. Further, in another similar case, the high court restrained Vivek Mishra and other parties from using Reliance Retail's "Independence" trademark till the next hearing on May 19.
In both cases, the high court asked Delhi Police's cyber cell to launch a probe and find out details of the entities that were infringing Reliance Retail's trademarks. The high court also directed WhatsApp to suspend the entities' accounts. The court further asked Meta Platforms Inc. to suspend the Facebook and Instagram accounts of these entities. Reliance Retail, whose outlets offer foods, groceries, apparel and other products, is a subsidiary of Reliance Industries Ltd.
Further, the court ordered Linkedin Corp. to suspend the entities' accounts on its platform. It asked social media platform X, formerly known as Twitter, to suspend the accounts of these entities. The Ministry of Electronics and Information Technology is directed to block domain names of the entities, said the court.
In the case involving "Reliance", "Campa" and "Campa Cola" trademarks, Reliance Retail had filed a suit seeking a permanent injunction against the entities for trademark infringement. Reliance Retail said the entities had illegally adopted its trademarks and its variants, and had issued offers for fake franchises relating to the company in return for money. In 2022, Reliance Retail had acquired Campa Cola and relaunched it next year as part of its strategy to enter the beverage market.
In the case regarding the "Independence" trademark, Reliance Retail filed a permanent injunction suit against the entities for deceiving the public by representing themselves as dealers of the company. The entities are imitating the "Independence" trademark and offering its distributorship and franchises in various parts of the country, said Reliance Retail. The company's brand "Independence" sells fast-moving consumer goods products, from staples to processed foods and other daily essentials.
At 1407 IST, shares of Reliance Retail parent Reliance Industries Ltd. were up 0.9% at INR 1,216.25 rupees on the National Stock Exchange. End
