Akoi family settles 16-year-old dispute over Imperial Hotel trademark

NEW DELHI – The Akoi family, which owns the Imperial Hotel in New Delhi, Tuesday told the Delhi High Court that family members have reached a settlement on a 16-year-old dispute over the "Imperial" trademark. As per the terms of the settlement, Hardev Singh Akoi and his late brother Jasdev Singh Akoi's sons Raidev Singh Akoi and Gobind Singh Akoi are the joint and exclusive owners of the "Imperial" trademark and will not have any rights on the trademark separately.
The Delhi High Court disposed of the case saying that both the parties were bound by the settlement.
The hotel, founded in 1931 by Ranjit Singh, was inherited by Rajdev Singh, the father of Hardev Singh Akoi and Jasdev Singh Akoi. Hardev Singh Akoi and Jasdev Singh Akoi had 50:50 ownership in the Imperial Hotel at Janpath in New Delhi. They were also joint owners of the "Imperial" trademark and the device of a "lion" with a crown.
Hardev Singh Akoi had moved the high court in 2008 claiming that Jasdev Singh Akoi circulated a book in the hotel rooms where his brother and family members were projected to be the sole promoters and owners of the hotel and the sole owners of the trademarks, despite knowing fully well that he was the joint owner of the trademarks. Hardev Singh Akoi also claimed Jasdev Singh Akoi changed the logo of the hotel without obtaining consent.
Hardev Singh Akoi also claimed that Jasdev Singh Akoi's family had applied for registration of the trademark "Imperial" and several other marks of which the word Imperial formed an essential feature. A similar attempt was also made in relation to the lion device, Jasdev Singh Akoi said.
When the case reached the high court, it restrained Jasdev Singh Akoi from modifying the trademark without the permission of Hardev Singh Akoi and referred the case for mediation. End
