IndiGo moves HC against Mahindra Electric in trademark suit over use of "6e"

NEW DELHI – InterGlobe Aviation Ltd. on Tuesday moved the Delhi High Court in a trademark infringement suit filed against Mahindra Electric Automobiles Ltd. for the latter's use of mark "6E" in its electric origin sports utility vehicle called Mahindra BE 6e, which was similar to IndiGo's International Air Transport Association code '6E'. Mahindra Electric is a subsidiary of Mahindra and Mahindra Ltd.
Justice Amit Bansal recused himself from the hearing and asked for the case to be placed before another bench. Advocate Sandeep Sethi, appearing for the airline, said that Mahindra Electric had reached out to them on Monday and an effort was being made to discuss the issue. The court will now hear the case on Dec. 9.
On Nov. 25, the registrar of trademarks had accepted Mahindra Electric's request to register the work mark "BE 6e" for a wide range of motor vehicles and related components. The next day, Mahindra Electric revealed its electric origin sports utility vehicle BE 6e and XEV 9e.
Mahindra and Mahindra said that it does not see a conflict as Mahindra Electric's mark is "BE 6e", not the standalone "6E". It differs fundamentally from IndiGo's "6E", which represents an airline, eliminating any risk of confusion. The distinct styling further emphasises their uniqueness, said Mahindra.
Informing the exchanges, Mahindra and Mahindra said that the company and its subsidiary had taken on board the concerns that InterGlobe Aviation have regarding infringement of their goodwill, which was not their intention. The company and subsidiary are engaged in discussions with IndiGo to find an amicable solution, said Mahindra and Mahindra.
On Tuesday, the shares of Mahindra and Mahindra ended 0.4% higher at INR 3,027.30 on the National Stock Exchange, while those of Interglobe Aviation ended 0.1% lower at INR 4,405.50. End
