Delhi HC stays trial against Congress' P Chidambaram in Aircel Maxis case

NEW DELHI – The Delhi High Court on Wednesday stayed trial court proceedings against Congress leader P. Chidambaram till the next date of hearing, in a money laundering case arising out of the Aircel Maxis deal. The high court issued a notice to the Enforcement Directorate on Chidambaram's plea against the trial court taking cognisance of the complaint by the probe agency.

 

Appearing for Chidambaram, advocate N. Hariharan that the trial court could not have taken cognisance without obtaining prosecution sanction, as the former Union minister was a public servant when the offence was allegedly committed. Contesting Chidambaram's petition on maintainability, the Enforcement Directorate said that sanction for prosecution was not required in this case as the allegations pertain to the actions of Chidambaram that had nothing to do with his official duties.

 

In 2021, the trial court had taken cognisance of chargesheets filed by the Central Bureau of Investigation and Enforcement Directorate against P. Chidambaram and his son Karti Chidambaram in the Aircel Maxis case. The case pertains to alleged irregularities in the Foreign Investment Promotion Board's approvals granted to the Aircel-Maxis deal in 2006, when Chidambaram was the Union finance minister. 

 

The probe agencies have said that when the INR 35-billion Aircel-Maxis deal went through, P. Chidambaram had received certain kickbacks to ensure the Foreign Investment Promotion Board's clearance for the deal, and the proceeds went routed through the companies associated with his son Karti Chidambaram.  End
