NEW DELHI – A delegation of the Bharatiya Janata Party on Monday submitted a complaint to the Election Commission of India seeking action against former Congress president and Leader of Opposition in the Lok Sabha Rahul Gandhi for claiming at his rallies that the BJP wanted to destroy the Constitution. The BJP delegation also demanded registration of a case against Gandhi for being in violation of the model code of conduct. Speaking to reporters after submitting the complaint, Law Minister Arjun Ram Meghwal said that Gandhi was running a false campaign against the BJP and spreading lies about the party by repeatedly saying that it would destroy the Constitution.
"A delegation of the BJP met the Chief Election Commissioner today (Monday). We told him that on Nov. 6, the Leader of the Opposition in Lok Sabha, Rahul Gandhi, tried to lie once again. During his Maharashtra election campaign, he attempted to pit states against each other," Meghwal said. "He (Rahul Gandhi) waved the Constitution and lied again that the BJP is about to destroy it. This is false. We told the poll panel that this should be stopped. We also told the panel that Rahul Gandhi is habitual of doing this, not deterring from it, despite warnings and notices. We said that an FIR should be lodged against Rahul Gandhi under Section 353 of Bharatiya Nyay Sanhita (BNS)."
Gandhi had alleged at a rally that the BJP and Rashtriya Swayamsevak Sangh want to destroy the Constitution. "There is a battle of ideology in the country. On one side, there is Ambedkar ji's Constitution, which has unity, equality, love and respect. On the other hand, there are people of the BJP and Sangh, who want to destroy the Constitution. But they don't say this openly because if they speak it openly, then the whole country will stand against them," Gandhi had said.
Voting in Maharashtra will be held in a single phase on Nov. 20, and the counting of votes will take place on Nov. 23. In the 2019 elections, the BJP and the undivided Shiv Sena contested elections in alliance and secured a majority by winning 161 seats – BJP 105 and Shiv Sena 56. The undivided Nationalist Congress Party had won 54 seats and the Congress party won 44. End
