Supreme Court notice to Centre, Delhi govts to implement land pooling policy in Delhi

NEW DELHI – The Supreme Court on Friday issued notices to the Centre and Delhi government on a petition seeking implementation of the land pooling policy and green development area policy in Delhi as given under the Master Plan for Delhi, 2021 and Draft Master Plan for Delhi, 2041, in a time bound manner. The top court also sought responses from the Lieutenant Governor of Delhi, Municipal Corporation of Delhi, and the Delhi Development Authority, and placed the matter for hearing on Dec. 20.

 

The petitioner, Delhi Dehat Vikas Manch, a registered society with more than 700 members, said that both the policies were introduced by the Delhi Development Authority as important components of the Master Plan for Delhi 2021 and have been further elaborated in the Draft Master Plan of Delhi, 2041. These policies are crucial for the planned and sustainable development of Delhi, which has witnessed rapid and disorderly development over the past decades, said the petitioner.

 

The policies are designed to promote planned urban growth by consolidating land holdings and encouraging public private partnerships in the development process, said the petitioner. However, despite being progressive and transformative, the implementation of these policies has been significantly delayed, leading to unauthorised and illegal development across the city, it added.

 

The delay in implementing the policies has worsened Delhi's infrastructural development, leading to significant natural calamities, including the recent floods in July 2023, said the petitioner. These floods exposed the vulnerability of the city's infrastructure, resulting in loss of life, damage to property, and severe disruption of daily life, the Delhi Dehat Vikas Manch said. 

 

The petitioner said that the master plans aimed to ensure a balanced and equitable growth for the city, addressing the needs of its growing population while maintaining the ecological and cultural heritage. However, the current state of Delhi's infrastructure is a glaring reflection of the haphazard and uncoordinated development, largely due to the lack of implementation of these plans, said the petitioner.

 

According to the petition, the land pooling policy is designed to prevent unregulated urban stretches, reduce congestion, and promote equitable distribution of resources, while the green development area policy is geared towards preserving green belts and ensuring that ecological concerns are combined into the city's expansion plans. The failure to implement these policies effectively has not only disrupted the city's growth but also poses a significant threat to its environment, said the petition.  End
