HC seeks CCI reply on removal of restaurants body from confidentiality ring

NEW DELHI – The Delhi High Court on Wednesday sought a reply from the Competition Commission of India and Swiggy Ltd on the National Restaurant Association of India's petition against its removal from the confidentiality ring by the antitrust watchdog in a case where the latter was examining anti-competitive practices by Swiggy and Zomato Ltd.

 

The counsel appearing for the restaurants association said that a report by the director general of the Competition Commission of India had come regarding a probe against Swiggy and Zomato. The counsel said that the association would not be able to file objections to the director general's report if it did not have access to the report and confidential documents filed by the two companies. The court will now hear the case next on Jan. 21, 2025.

 

In 2021, the association had filed some information against the two companies alleging anti-competitive behaviour. In 2022, the competition commission said that a prima facie case was made out and therefore ordered a director general probe against the companies. In the probe, Swiggy had given highly confidential information to the director general. The investigation was completed by the director general in March.

 

Thereafter, Swiggy and Zomato filed applications seeking confidential versions of the director general's findings. The association also sought a confidential version of the director general probe against the two companies. However, the Competition Commission of India removed the association from the confidential ring, to which it moved the Delhi High Court.  End
