Delhi HC bars party from using Dream 11's trademark, layout in website

NEW DELHI – The Delhi High Court has barred Hong Yi F5 and other parties, owner and operator of a website that had replicated an earlier version of Dream 11's website, from using Dream 11's trademark and layout. The court also ordered GoDaddy.com LLC to transfer Hong Yi's domain name to Sporta Technologies Pvt. Ltd., which owns and operates the Dream 11 fantasy sports platform.
The court said Hong Yi and other parties had taken unfair advantage of the reputation and goodwill of Dream 11's trademark and artistic work, and deceived unwary consumers by dishonestly adopting the plaintiffs' registered marks without any explanation.
The court was hearing a suit by Sporta Technologies and its holding company, Dream Sports Inc., seeking a permanent injunction to restrain the defendants from infringing its trademark and copyright. In 2019, the petitioners had signed a central sponsorship contract with the Board of Control for Cricket in India for the Indian Premier League. Last year, BCCI had also announced Dream 11 as the lead sponsor of the Indian cricket team.
Hong Yi's website claimed to offer fantasy sports identical to those provided by the petitioners. On Hong Yi's website, the "registered account" link and the hyperlinks in "How to Play on Dream11 App" frequently asked questions section redirected users to "http://www.gugobet.com/", which actively promotes betting and gambling activities. The petitioners said the Gugobet sponsor section of the website claims it is "one of the biggest global sports betting websites, founded in the UK since 2006". End
