Lessor files contempt plea in HC against Go First for not sharing documents

NEW DELHI – Go First's lessor Accipiter Investments Aircraft 2 filed a contempt plea in the Delhi High Court on Tuesday against the airline for not sharing documentation in relation to its leased aircraft. The documents include technical records, aircraft status documents, statements in relation to the aircraft, and any record as required to ascertain the airworthiness of the aircraft.
The high court noted the statement of Go First's resolution professional, which said records are being shared with the lessor. The court asked Accipiter Investments to supply a list of all remaining documents to Go First. The court asked the resolution professional to supply all the documents by Nov. 30 and file a short compliance report on this. The court will next hear the case in January.
The National Company Law Tribunal on May 10, 2023, admitted a voluntary insolvency application by Go First and declared a moratorium on all its assets. Consequently, the Directorate General of Civil Aviation informed the lessors that it could not process their application for deregistration as there was a moratorium on the airline's assets. Challenging these, a bunch of lessors moved the high court, seeking directions for the Directorate General of Civil Aviation to deregister aircraft leased from them.
On Apr. 26, the high court asked the Directorate General of Civil Aviation to deregister 54 aircraft leased by the airline. The court permitted the lessors to export the aircraft and directed the aviation regulator to facilitate this by providing airworthiness certificates. The high court also asked the resolution professional to provide up-to-date information and documentation related to the aircraft to the lessors. End
