SC stays UP order to shift students in unrecognised madrasas to govt schools

NEW DELHI – The Supreme Court on Monday stayed the Uttar Pradesh government's order which had said that all students in unrecognised madrasas and non-Muslim students studying in government-aided madrasas should be shifted to government schools. The Bench, led by Chief Justice of India D.Y. Chandrachud, also stayed the National Commission for Protection of Child Rights' communication to chief secretary of Uttar Pradesh asking it to withdraw the recognition of madrasas not compliant with the Right to Education Act, 2009.

 

The Bench, also comprising Justice J.B. Pardiwala and Justice Manoj Misra, said that the communication by the commission should not be acted upon and subsequent directions by the Uttar Pradesh government and the Tripura government be stayed. The Tripura government had also given an order like the Uttar Pradesh government regarding madrasas. The top court also issued a notice to the National Commission for Protection of Child Rights, the Centre, the Uttar Pradesh government and other parties on a petition by Jamiat Ulama-i-Hind. The petitioner had termed the order "unconstitutional" and a violation of the rights of minorities. 

 

Earlier in a different case, the top court in April had stayed the Allahabad High Court's order to declare the Uttar Pradesh Board of Madrasa Education Act, 2004, as "unconstitutional". The top court had then said that the high court's order would impinge on the future course of education of nearly 1.7 million students who were pursuing education in these madrasas. According to media reports, Uttar Pradesh has approximately 25,000 madrasas. Of these, 16,000 are government-recognised and 560 are government-aided.  End
