PIL in HC against mobile apps sharing vehicle owner details; govt to probe

NEW DELHI – A public interest litigation has been filed in the Delhi High Court against several mobile applications allowing access of sensitive information related to any vehicle by entering its registration number. The government said that it has taken the allegations in the petition very seriously and was enquiring into the matter. The court asked the Ministry of Road Transport and Highways to file a detailed affidavit and listed the case for hearing on Feb. 19.

 

The petitioner Gopal Bansal, a lawyer, sought directions to the transport ministry to set aside the Policy for Providing Access to Information from National Register – A Centralized Database of DLs (Driving Licenses) and RCs (Registration Certificates). The petitioner also sought the Ministry of Law and Justice to frame legislation for protecting the aforesaid National Register. Further, the petitioner asked the Ministry of Electronics and Information Technology to stop the operation of the mobile applications involved in breach of data contained in the National Register. 

 

The petitioner said that sensitive information related to any vehicle is exempt from disclosure even under Section 8(1)(a), (e), and (g) of the Right to Information Act, 2005. The petitioner said that information had been sold to third party entities by the transport ministry under the erstwhile Bulk Data Sharing Policy and Procedure Policy, which was subsequently scrapped. However, even under the new policy, the data is being sold, said the petitioner. The counsel appearing for the government said that the National Informatics Centre has not granted information to the applications mentioned in the petition.  End
