Delhi HC bars 'Taj Iconic' from using 'Taj' brand name

NEW DELHI – The Delhi High Court has permanently restrained "Taj Iconic Membership", a company that offers discounts to its members in hotels and restaurants, from using the "Taj" brand name in its corporate name and logo in a trademark suit filed by The Indian Hotels Co Ltd, part of the Tata group of companies. 

 

The high court asked the managing director of Taj Iconic to pay damages of 1 mln rupees and a cost of 500,000 rupees to The Indian Hotels.

 

"It is apparent that the use of the various contents and photographs available on the plaintiff's website, by the defendant in relation to business activities, has the effect of inducing the consumers and members of the trade to falsely believe that the defendant has a direct nexus or affiliation with the plaintiff," the court said. 

 

The court said that the fraudulent and illegal trade activities of Taj Iconic also have the effect of causing incalculable harm and injury to the business, goodwill and reputation associated with the petitioner's associated trademark.

 

Taj Iconic is not only guilty of infringement of the petitioner’s marks and photographs, but has also indulged in criminal activities by impersonating the petitioner and defrauding a jeweller of 100 gold coins worth 5.1 mln rupees, the court said.

 

The court was hearing a trademark suit filed by The Indian Hotels against Taj Iconic's unauthorised use of its registered trademark Taj, as well as various content and photographs available on www.tajhotels.com and the photographs of Taj Mahal Palace Hotel in Mumbai.  End
