SC grants bail to Arvind Kejriwal's aide Bibhav Kumar in assault case

NEW DELHI – The Supreme Court today granted bail to Bibhav Kumar, the aide of Delhi Chief Minister Arvind Kejriwal, in connection with a case registered against him for allegedly assaulting Aam Aadmi Party's Rajya Sabha member Swati Maliwal. The apex court said that Kumar has already spent more than 100 days in custody and the trial was likely to take some time as more than 51 witnesses are to be examined.

 

This is a case for bail as Maliwal's injuries, as per the medical reports, are two bruises, which are minor in nature, the bench of Justice Surya Kant and Justice Ujjal Bhuyan said. Since the chargesheet has already been filed, Kumar's release will not cause any prejudice to the probe, which is already complete, the bench said.

 

The apex court said that Kumar should not be restored to the position of personal secretary of Kejriwal or given any official assignment in the chief minister's office. Kumar should not enter the chief minister's residence till the "private vulnerable witnesses" are examined, said the court. Kumar should not make any public comments regarding the case, the court said.

 

The Delhi police arrested Kumar on May 18 for allegedly assaulting Maliwal when she visited the chief minister's residence on May 13. AAP had refuted Maliwal's allegations, calling the incident a conspiracy by the Bharatiya Janata Party to frame Kejriwal, who is himself in judicial custody in another case.  End
