HC sends Burger King, Burger Farm to mediation in trademark case

NEW DELHI – The Delhi High Court today referred the American multinational chain of hamburger fast restaurants Burger King Company LLC and an Indian entity Burger Farm to mediation on a trademark infringement suit filed by the US company.
Burger King had argued that Burger Farm deliberately copied its trademark logo. The US company said that it launched its first restaurant in India in 2014 and Burger Farm had come into existence in that year. Burger King said that there has been an attempt by Burger Farm to come closer to their business.
The US company said that there was overwhelming evidence of confusion among the customers. Burger King showed the court various comments on social media saying Burger Farm was a "cheap copy" of the US company. This is something that even trademark law does not permit, said the US company.
Burger Farm said that it was based out of Jaipur, and it would try to change its logo and reach a settlement. Burger Farm contested any injunction by the high court, saying that it has various outlets all over India. End
