Delhi HC bars Shanvi Groups from using trademark of Prakash Pipes

NEW DELHI – The Delhi High Court today barred Shanvi Groups from using the trademarks and copyrights of Prakash Pipes Ltd for its PVC pipes and fittings. Passing an ex-parte permanent injunction against Shanvi Groups, the court also awarded damages costs of 500,000 rupees to be paid by the groups to Prakash Pipes.
The court found Shanvi Groups guilty of passing off the trademark of Prakash Pipes, as it offered and sold products under them in the open market thereby misleading and confusing consumers into believing that those products originated from Prakash Pipes. Shanvi Groups tried to take benefit of Prakash Pipes, its well established goodwill and reputation, to take an undue advantage, said the court.
The high court was hearing a plea from Prakash Pipes, seeking a permanent injunction against Jaiswal Traders and Shanvi Groups. Prakash Pipes had come across the infringing products sold by Jaiswal Traders, who had thereafter tendered a written apology to them and said that the goods were procured from Shanvi Groups. In January, Prakash Pipes and Jaiswal Traders had compromised the matter and a decree was passed accordingly by the court.
Today, shares of Prakash Pipes ended 2.5% lower at 620.30 rupees on the National Stock Exchange. End
