Delhi HC asks judge to examine Mankind Pharma's trademark case afresh

NEW DELHI – The division bench of the Delhi High Court has asked the single judge bench to decide afresh on Mankind Pharma Ltd's plea seeking a temporary injunction against Chandra Mani Tiwari and other parties from adopting and using the name Mercykind Pharmaceuticals Pvt Ltd. The single judge bench should take up Mankind Pharma's plea with due expedition, subject to its roster and pending old cases.
"Although we are informed that during the pendency of the present appeal, the defendant (Chandra Mani) has made significant changes both in its logo and get up of products which are being marketed by it, in our considered opinion, these and other issues which arise would clearly merit consideration afresh by the learned single judge," said the court.
Mankind Pharma has alleged that Tiwari was initially working with it as a marketing manager till he left the company on Jan 17, 2015. Mankind Pharma said Tiwari initiated the process of incorporation of a company under the name Mercykind Pharmaceuticals. Mankind Pharma had contested the use of the suffix "Kind" by Tiwari for the company.
Mankind Pharma said it adopted "Mankind" as a trademark in 1986, and that it holds as many as 157 trademarks with the suffix "Kind". In 2018, the single judge bench of the court had refused any temporary injunction against Tiwari. Challenging this, Mankind Pharma had moved the division bench.
On the National Stock Exchange, shares of Mankind Pharma closed over 1% higher at 2,175.65 rupees today. End
